Legislative Decree no. 196 dated 30 June 2003
As per the Legislative Decree no. 196 dated 30 June 2003, everyone has the right of protection of the personal data concerning them.
CTA, as data controller, has to give instructions about it.
This consolidated statute, hereinafter referred to as “Code”, ensure that personal data are processed by respecting data subjects’ rights, fundamental freedoms and dignity, particularly with regard to confidentiality, personal identity and the right to personal data protection.
This Code rules the processing of personal data, i.e. any operation, or set of operations, carried out with or without the help of electronic or automated means, concerning the collection, recording, organization, keeping, interrogation, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data, whether the latter are contained or not in a data bank.

The data protection code guarantees that the data subject as well as any entity from whom or which personal data are collected shall be preliminarily informed, either orally or in writing, as to:

Processing arrangements and data quality
Personal data given to CTA are collected from the data user.
Personal data undergoing processing are:
a) processed lawfully and fairly;
b) collected and recorded for specific, explicit and legitimate purposes and used in further
processing operations in a way that is not inconsistent with said purposes;
c) accurate and, when necessary, kept up to date;
d) relevant, complete and not excessive in relation to the purposes for which they are
collected or subsequently processed;
e) kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data were collected or subsequently processed.

CTA do not ask for sensitive data.

‘Sensitive data’ are personal data allowing the disclosure of racial or ethnic origin, religious, philosophical or other beliefs, political opinions, membership of parties, trade unions, associations or organizations of a religious, philosophical, political or trade-unionist character, as well as personal data disclosing health and sex life.

Sensitive data may only be processed with the data subject’s written consent and the Garante’s prior authorization, by complying with the prerequisites and limitations set out in this Code as well as in laws and regulations.




Purposes and Data Minimization principles
The processing of personal data is regulated by affording a high level of protection for the rights and freedoms in compliance with the principles of simplification, harmonization and effectiveness of the mechanisms by which data subjects can exercise such rights and data controllers can fulfill the relevant obligations.

Processing Arrangements
Personal data is processed by CTA with automated means for no longer than is necessary to achieve the purposes for which it has been collected. Specific security measures are implemented to prevent the data from being lost, used unlawfully and/or inappropriately, and accessed without authorization.

Optional Data Provision
Subject to the specifications made with regard to navigation data, users are free to provide the personal data either to be entered in the application forms submitted to CTA or referred to in contacting CTA to request delivery of information materials and other communications.
For completeness' sake, it should be pointed out that in some cases – which are not the subject of the standard management of this website – our Authority may request information pursuant to Section 157(1) of Legislative Decree no. 196/2003 with a view to supervising the processing of personal data. In these cases it is mandatory to comply under penalty of administrative penalties.

Data Subjects' Rights
Data subjects are entitled at any time to obtain confirmation of the existence of personal data concerning them and be informed of their contents and origin, verify their accuracy, or else request that such data be supplemented, updated or rectified (Section 7 of Legislative Decree no. 196/2003).
The above Section also provides for the right to request erasure, anonymisation or blocking of any data that is processed in breach of the law as well as to object in all cases, on legitimate grounds, to processing of the data.
